An Act to pretcribt the time, place, and manner of electing United State* Senators, and to fix the penally upon officers failing to certify to taid election.

SKCTIOS Be itr enacted by the General Assembly of the State of Indiana, That iiie election of United States Senators may be held at any time daring any sesaiun of the Legislature, whenever a vacancy in that office .exists or occurs, or at any session next preceding the time when according to law such vacancy will occur, and tho places of holding such electron shall be tho same as now, or may hereafter/be prescribed by law for the settings of the two Houses of the General Assembly.

S«c. 2. The manner of said election bhall be by viva voce vote of the Senate and House of Beptcsentative,

SEO. 4. The elections herein provided for may bo entered into at any time in cithor House, upon motion and assent of tho Houso theroto. And nominations shall be made and votes taken as in case of electing officers of the respective Houses.

SKC. 6. Tho failure, neglect or refusal of any one of the officers named iu the third section of this act, upon the requost of any person elected to the office of Senator ot the United States, as herein pro vided, to perform any duty or duties imposed upon hire by this act, shall be deem ed, and is hereby declared to be a misdemeanor and upon prosecution by inform at ion in the Court of Common Pleas of Marion County, and conviction thereof, tho person

But should any one or all of the officers whose duty is in this section before declared, neglect, fail or refuse to discharge his duty as heretofore prescribed, then, and in that case sworn copies of the journals of the two Houses verified by tho affidavit of any sworn officer, or by any tncmbor of tho respective Houses com posing the General Assembly, shall in all cases, and for all purposes, be deemed, taken and roceivod as competent and sufficient evidence, however, that such sworn copy or copios of such journals, shall iu all cases be accompanied by a resolution of each Hone, declaring tho neglect, failure or refusal of such officer or officers to discharge his or thoir duties as heretofore prescribed, and a copy of such resolution i»worn to as provided fo» in the case of the journal aforesaid, shall in all cases be deemed and taken and received as sufficieut evidence of such neglect, failure or refusal on the part of such officer or officers, and shall entitle the aforesaid sworn copies of tho journals of tho two Houses of the General Assembly to the same faith and credit as if certified under the broad seal of the State, as heretofore provided.
