This being the case, it follows (hat the Citizens' bank of Gosport is an illegal intuit ution and father, that because of it* illegality, its issues are vpid. (See Curtis et al vt. Leavitt, 15, N Y., Court of Appeal*, by Smith, p. I.) And being void, the law is well settled that it can not be made the foundation of an action. Any consideration given for them may be recovered back, but a suit on the bills is not maintainable.
