Geo. 8. Hamilton died in that city in ^December, leaving a widow, Margaretta, ^nnd three childron, aged 911 and 13 year. As the husband wag a Protestant and the wife a Catholic, he appointed guardians for tho children, by will, and directed them to bo brought up in tl.o Protestant faith. Tho children wore accotdingly taken front tho mother and placed at a Protestant school, but th« mother applied for a writ of habeas corpus, to recover them. Judge

This statute enacts that any fathor, nndor ago or of full ago, may b^ deed or will diwposo of the custody of his child, either born or unborn, to any person, except a Popish roeusartt, either in possession or reversion, till such child attains the age of -ono and twenty years.
