To whom do.ire owe the imperfections of these laws? Let the voters of each district in the State reflect, look back and mark the men who have thus trifled with the feelings anl the m03t anxious desiros of a large majority of the citizens of Indiana, and, in the language of the JSvansville Journal, "if the constitution contains such restrictions as our Supreme Court finds in it, upon the power of the government and people to adopt. measures for the moral and intellectual advanoemcM of wff-pojsu-lation, it should be abolished} or amended at once." But, if the fault lies in tbe wording and peatliar construction of ^sentences, in the law passed in accordance with the provisions of tho preseut Gonstitution, tho citizen^ qf ^ifdiana should guard well their interest* in this respect, at tho next selection of members of tho Legislature,-'and choose men who hmv4 an inhrest in tho welfare of tkoir constituents, so that the law may be.refued and perfected beyond (be possibility of a quibble.— This can bo doper and must be, 4«ac-^|w.r owe it to our cbildron and to ppsterity.

The Court say: Tho solo question proson tod in the case is whether the section of the Statute abovo quoted is constitutional, and we can scarcely regard it as Sn open one.
The act of 1852,1 R. S. 4Hp Stfe. 32. and p. 454, Seo. 180. authorised in* corporatcd cities and towns to levy Uxes for the support of Public Sohools after tke public funds had bee* exhausted, and this Court, on all oocasioM, has held that portion of the aci unconstitutional. But what is the difference between it, and! the section of the act of 1655 which we have quoted? Simply this, and nothing more. Tho act of 1H52 authorise* incorporated cities and towns "to levy taxes for the support of their Schools after tbe public fands shall [should] have been ej&ausfced." The act of 1855 authorises "incorporated ottiea and towns" "to levy and collect such tax* es as may be necessary from time to tin* for the support'* of "Pnblic Schools" within their corporate limits. To remoldy this evil to give us this uniformity aud quality to secure a united and vigorous, instead of a divided and thus weakened Common School system and interest to place upon the Legislature a compulsion to, by its own action, gifce ns these advantages instead of hazarding them, with the voluntary action of'municipal corporations, the new constitution provides that it should be the duty of the (general Assembly to provide by lawrfor a ctu "general and uniform system of Common Sohools, wherein, tuition .shall be* without charge, and equally open to all." Th§ System must operate equally in city and country, or it will not be uniform.
