A Plain Case.
By the terms of the "Butler Bill" the Stiit,e of Indiana pledged the revenues of the Wabash ami Erie Canal for the payment of the canal stocks, the canal siocnholders agreeing, in consideration thereof to lorever release the Slate from all further liability to pay the same. Under that arrangement the stockholders have been receiving the canal Revenues and tolls for a period of 23 years. So long as the Siate secures the payment of these tolls and revenues to the stockholders they have no cause to complain, because they are getting just what tuey bargained for, and just what the Suite had agreed to give them, it now turns out that the holders of some old inter.lal improvement bonds, not surrendered until the "Butler Bill," have alien upon the Wabash and Erie Canal for the amount of their bonds and interest, which is prior •to the lieu created in favor of r.he canai stockholders by the "Butler Bill." The Supreme Court of the United Slates have expressly decided .so in 2d Black Reports, page 440. Under this decision the holder of 41 of these old old improvement bonds has commenced foreclosure proceedings in the Carroll County Circuit Court, and unless his claim is paid the Court will order the Wabash & Erie Canal to be sold to pay it Mr. Garrett, the holder of these bonds, is not asking the State to pay his claim, but is seeking his legal remedy by due process of law. The canal stockholders are knowing to these proceedings, and are *u»t only willing but anxious that Mr. Garrett should foreclose his lien and «ell the canal. Why? Because when that is done, the consideration for their agreement under the "Butler Bill" will have failed, and they will be in a position to demand a recession of that agreement, and a reissue to ilu\in of the bonds they surrendered under it, which, with interest, will now iiuvumt to nearly eighteen millions of dollars. By the payment of the old bun the hen of the holders will be extinguished, and the canal tolls and revenues will be forever secured to the holders of the stocks issued under the "Butler Bill." The duty of the Legislature is plain. By a Jaw -providing for the payment o! the old bonds, the Siate will be saved from a liability to pay eighteen millions of dollars. Tnis is a question in which men of all parties and men of no party are equally "interested. It is tlie most important question that will come before the present Legislature. A course of policy that will result in creating a State debt. jf eight millions of dollars will consign any man or party that supports it to the "the tomb of the Capuiets." We are glad to be assured that good men of all parties are disposed to .unite their efhuts to defeat the sctjyeine.—
