Black feels wording of opinion may have delayed integration

By CHARLOTTE MOULTON WASHINGTON (UPI)— Justice Hugo L. Black feels the Supreme Court may have erred 13 years ago when it ordered all school districts permitting or requiring racial segregation to abolish that practice “with all deliberate speed.” Although Black supported the historic 1955 ruling intended to enforce a 1954 decision ending the long-established “separate-but-equal” doctrine in education, he believes the court might have done more to accelerate the pace of desegregation had it not used the now famous phrase. “Looking back on it now, it seems to me that it delayed the process of outawing segregation,” said the 82-year.old Alabaman during a rare hourlong interview taped in his Alexandria, Va., home and broadcast Tuesday night by the Columbia Broadcasting System. * * * Less than 1 per cent of the nation's electrical output is nu-clear-powered, but the figure is expected to reach 20 per cent in the next 10 years.

Black appeared to be saying he stood in agreement with liberal critics of the court who have argued that the “all deliberate speed” approach was too vague and invited disobedience in the south. The aging justice also expressed his views on obscenity, dissent and the rights of criminal suspects. Black said obscenity, which still sharply divides the nine court members, remains a “wholly ambiguous” concept. He has always advocated total absence of governmental power to restrict free speech. “Of course I understand that pornography sounds bad,” he said. “But I have never seen anybody who’d say what it is. Nobody. If the idea is to keep people from learning about the facts of life as between the sexes, that’s a vain task ” Black also said he did not believe constitutional protection of free speech should be guaranteed for demonstrators who dissent by occupying property which is not their’s. Not Protected “The first amendment

protects speech and it protects writing and it protects assembly, but it doesn’t have anything that protects a man’s right to walk around and around and around my house if he wants to fasten my . . . family up into the house, make them afraid to go out of doors,” he said. Commenting on recent court decisions restricting police interrogation and assuring protection for suspected criminals, Black said critics of the court should blame the framers of the Constitution. “They were the ones that put in ‘no man shall be compelled to convict himself,’ ” he said. Asked if he thought the court’s action had made it more difficult for police to combat crime, Black replied; “Certainly, why shouldn’t they? What were they (Constitutional guarantees) written for? Why did they write the Bill of Rights? Practically all of (the provisions) make it more difficult to convict people of crime . . . they were written to make it more difficult and what the court does is try to follow what (the framers) wrote.”

You bid One Club, North One Diamond, you One Heart. North Two Hearts. East-West pass throughout. What would vou bid now? • • » 1. Two clubs. North probably has 8 or 9 points including a spade stopper for his notrump bid. Game is therefore unlikely, and two clubs is apt to be a safer contract than one notrump. Of course, North may have a 10-point hand including two spade stoppers, but until he identifies such a holding, you cannot assume it. It would be wrong to bid two hearts. This would constitute a reverse bid, indicating a much stronger hand, and you might easily wind up too high. 2. Two hearts. This is not a reverse, since two hearts is the cheapest bid you can make. However, you should now view this hand as much more promising for game purposes than the preceding one. Partner’s diamond bid raises the value of your hand several points, and in this sequence he very probably has more than 10 points. But for the moment, all you do is mark time with two hearts.

North is unlikely to have four hearts, since he failed to respond one heart, although he may have bypassed the suit for tactical reasons. There are three possible bids three diamonds, three hearts and four hearts — and they all make sense. You probably won’t make four hearts if partner has the wrong type of hand, and that is the chief objection to an immediate leap to game. A three heart bid would invite partner to go on to four, but would merely announce extra values without delineating what they are. A three diamond bid has the added virtue of not only identifying extra values but also describing the threesuited nature of your hand.
