Supreme Court May Get Case LOUISVILLE UPI—An ap-

peal to the U. S. Supreme Court may be made by an attorney for a white woman who married a Negro musician and lost cus-

tody of her five youngsters. George Crumlin, representing

Mrs. Ann Eilers Anderson of Indianapolis, charged that Jefferson County Circuit Judge Lyndon Schmid “made his deci-

sion on race and race alone”

when he awarded the children to their father, George Eilers

Of Louisville.

“We feel that it is virtually immoral if not illegal to say

that she must five up her children because she married cut of her race,” Crumlin said. Crumlin said the case would be presented to the Kentucky Court of Appeals within thfc next 60 days. “We hope to get a favorable ruling from the court of Ajh peals and if we don’t we are prepared to go all the way to the U. S. Supreme Court,” he said. The five children are now living with their father here. Crumlin said he has visited the children and alleged that Eilers has convinced them they do not want to return to their mother.
