Court Orders A New Trial INDIANAPOLIS UPI — The Indiana Appellate Court has ordered the Morgan Circuit Court to grant a new trial to a New York bonding company in connection with a dispute over who should receive $25,000 the Martinsville Metropolitan School District is holding. The case concerned construction of the Centerton school for which a contract was signed in 1955. Evidence showed that Robert Carey, the contractor, failed to complete the agreement and the Fidelity and Casualty Co. of New York, his bonding company, finished building the school. The transaction was complicated by the fact the Indiana National Bank of Indianapolis loaned money to Carey. Indiana National sued the school district, claiming $18,293 of the reserve. An additional complication was that Carey was performing work for schools in Marion, Madison and Blackford Counties during the same time he was working on the Centerton project. Morgan Circuit Judge John Sedwick, Jr., ruled that Indiana National should receive $12,440 and Fidelity $12,701. He also found that the fund used by the bank was used in part on the schools in the other three counties. The bonding company appealed Sedwick’s finding and Judge Joseph Carson of the Appellate Court wrote that the lower court ruling did not “conclusively show that the money loaned by the appellee bank was used to discharge debts for which the surety might have been liable.” “The evidence in the record does not support the mathematical division of funds. The judgment of the court is therefore contrary to law and should be reversed and this cause remanded to the trial court with instructions that the appellant’s motion for a new trial be granted.”

Menacing crowds gathered Thursday in downtown Santo Domingo, stronghold of leftist candidate Juan Bosch, virtually halting late-aftemoon traffic. Police posted a strong guard at Balaguer’s home and used tear gas to break up one crowd. Change locnle BRACKNELL, England UPI —A group of army cadets has changed the location o f its parade grounds because of embarrassment caused by the wolf whistles received when marching in view of a neighboring girls club. In Memory In memory of our dear mother, Addie Irwin, who passed away five years ago, June 3rd, 1961. Somewhere beyond the rainbow’s end The skies are bright and fair No showers dim — no darkness falls The land is peaceful there And Someone with the power to heal To guide and understand. Is waiting there to calm our fears And take us by the hand. So when a dear one heeds His call Our hearts should be at rest For there beyond the rainbow’s end A loving God knows best. The children.
