BLFE Members Have Painful Reading In Federal Court Decision On Labor Case
WASHINGTON UFX — A federal court rating is providing some painful reading for officials of the Brotherhood of Locomotive Firemen A Enginemen (BLFE) who are fighting to keep their members aboard diesel trains. U. S. District Court Judge Alexander Holtxoff sided with the railroads Wednesday in issuing a final Judgment in a ease Involving two other rail unions, the Brotherhood of Railroad Trainmen and the
Switchmen’s Union of North America. Hottaoff said the trainmen and the switchmen would have to start again through the builtin delays of the Railway Labor Act if they want to make changes in the crew sizes worked out under a federal arbitration award. The award expired Jan. 25 for the trainmen and the switchmen, and March 30 for the BFLE. The firemen pulled a surprise strike shortly after
midnight of the day the award expired, tying up eight major railroads in 38 states to dramatize their demand for an apprentice training program. During the two-year period covered by the federal arbitration award, more than 18,000 firemen’s jobs have been abolished under the arbitrator’s finding that they were not necessary for safety and efficiency. The BLFE contends that the railroads must reinstate fire-

man aboard aU diesel trains under a 1960 agreement now that the federal award has expired. Hie railroads challenge this view. They have asked Hoitzoff to rale that the 18,000 jobs are, in effect, gone for good, unless restored by agreement. Hoitzoff accepted the railroad view in the case involving the trainmen and the switchmen. He held that a new manning situation had been created that could not be altered without going through the time-consum-ing procedures of the Railway Labor Act This could take months, perhaps years. A hearing has been set for April 27 on a similar issue in the firemen’s case. If Hoitzoff makes the same ruling—and it seems likely he will—it would be a severe blow to the BLFE.
