Samocki was charged with wilful failure to file Federal Use Tax Returns on Highway Motor Vehicles, Form 2290, in violation of Section 7203, Internal Revenue Code of 1954, for the period 7-1-60 thru 6-30-63. This is the first prosecution undertaken in the State of Indiana under the Federal Highway Use law which became effective July 1, 1956. Under this law, a return. Form 2290, covering all taxable vehicles in use on any public highway during July of each year must be filed and an annual tax paid not later than the last day of the following month. The tax is for the following twelve - month period ending June 30th. For any vehicles put in use after the month of July, an additional Form 2290 must be filed for these vehicles and a pro-rated tax paid for the number of
though the vehicles are replacements of vehicles on which a tax has been paid. The law provides that the tax be computed on a taxable gross weight, which is established by regulations for each catagory of
vehicles.
Mir. Samocki is a partner in Samocki Brothers, a trucking firm located at 5030 Industrial Highway, Gary. The firm is engaged in construction hauling and during the years Involved in the criminal action, they operated as many as seventeen trucks which were subject to the Highway Use Tax. Mr. Samocki failed to file returns and pay Highway Use tax for a four-yr.-period beginning July 1 ’59, and ending June 30, 1963. Although Mir. Samocki resides in Gary, the criminal action was undertaken in the Southern Judicial District as the returns are required to be filed with the District Director of Internal Revenue at Indian-
apolis, which Is In the Southern Judicial District Persons convicted of failure to file tax returns are subject to a fine of not more than 910,000 or imprisonment of not more than one year or both together with the costs of prosecution. Father Held For Cruelty To Sen MARTINSVILLE, —UPI— A truck driver was jailed during the weekend on charges he held his 5-year-old son’s hand over a cigarette lighter and burned it so badly be lost parts of two fingers. Prosecutor Richard Bray said Herschel Dawson, 26, R. R. 1, Paragon, arrested on a charge of crulty to a child, admitted burning the boy but said he did it to teach the lad not to play with matches. Dawson’s son, Ronald, was taken to Morgan County Memorial Hospital here Dec. 19 for treatment of a hand wound which resulted in the loss of parts of two fingers. He was treated until Jan. 12 when he was dismissed from the hospital. The charge against Dawson alleged that the burning occurred Dec. 2, 17 days before the boy was hospitalized. Morgan County Welfare director Harry Lusk and Bray investigated circumstances surrounding the injury which resulted in filing of the charge. Would Cut Aid To 6 Parishes WASHINGTON UPI—A U.S. Officer of Education hearing examiner recommended Monday that federal aid to schools in six Louisiana parishes counties be cut off because of evidence of racial discrimination. Hearing examiner Merrit Ruhlen made the findings in cases involving Tensas, Union, Vermillion, Webster, West Carroll and Winn parishes. The decisions were the first in cases against 52 southern school districts which have been cited for refusing to comply with the desegregation provisions of the Civil Rights act of 1964. The act provides that federal aid should not go to the schools where there is evidence of segregation. The findings of the hearing examiner must be reviewed by the commissioner of education and by Secretary John W. Gardner of Health, Education and Welfare.

Planning Fund Loans Approved INDIANAPOLIS UPI — The State Board of Finance at a meeting Monday in Governor Branigin’s office approved postwar planning fund loans to three towns, to be used for comprehensive planning for future development. The loans were 92,000 to West Baden, 92,450 to Montpelier, and 9750 to Zionsville. The board also agreed, after tabling the matter two weeks ago, to reimburse the federal government for 920,666 on disallowed charges. The state had charged Uncle Sam rent for civil defense and other agencies in the State office Building. The federal government had refused to pay the amount until recently when a rule change permitted the payment. Budget Director Jack Booher explained that the 920,666 represented the rent charged before the rule change went into effect.
