Court Rejects Barry's Appeal WASHINGTON UPI — The Supreme Cout has rejected Sen. Barry M. Goldwater’s attempt to require the television networks to give him equal and free time to reply to President Johnson’s recent broadcast on world affairs. The court's 6-2 decision late Wednesday upheld a ruling by the U.S. Court of Appeals that the Federal Communications Commission was correct in deciding that the three networks did not have to allow the Republican presidential nominee equal time to answer Johnson’s speech. The lower court said that the President’s discussion of the change in Russia's leadership and the detonation by Red China of an atomic bomb was

exempt from the “equal opportunities” requirement in the federal law. Justice Arthur C. Goldberg and Hugo L. Black disagreed with the Supreme Court majority in a three-page dissent. They said the high court should have granted Goldwater’s request to review the appeals court decision in oral arguments. The court is out of session now until Nov. 9, but could be convened for a legal emergency.
