Texas Court Of Appeals Upholds Estes Conviction

AUSTIN, Tex. UPI — A Texas court of criminal appeals has upheld the conviction of Billie Sol Kstes on swindling charges and ruled he must serve eight years in the state penitentiary. The three-judge court upheld the verdict of a jury at Tyler, Tex., in a 22-page unanimous decision. Kstes, former agriculture tycoon from Pecos, Tex., was f h ;od specifically with swindling a farmer, T. J. Wilson, in a ■'!>4.G00 deal involving anhydrous ammonia fertilizer tanks. E tes. now living in Abilene, Tex., also is under a 15-year-sen-tence by a Federal Court on his conviction on fraud and conspiricy ch rges. The federal conviction is under appeal. Estes and Wilson signed a contract on March 2, 1961, involving 75 tanks of 500 gallon capacity, along with mobile mounting and npplicating equipment, and for 65 similar rigs of 200-gallon capacity. Wilson agreed to pay Estes '121,850 and made a down payment of 527,350 that left a balance owed by Wilson of $94,500 payable in monthly installments of 51,575. I'he state charged that Estes falsely represented to Wilson thit he was buving the property and it was to be security for the mortgage, in much the same manner t h a t a person buys an automobile. The state said, however, that Wilson was in fact not purchasing the property and it was not security for the debt. A state court jury took 127 minutes to convict Estes on Nov. 7. 19*12. after Prosecutor R B. McOowen warned, “If you acquit Billie Sol Estes you are doing one more thing to turn our way of life over to the crooks and hucksters.” Tho trial lasted 17 days and the sentence was two years less than the maximum. Estes, now 39, was freed In bond awaiting appeal of the de-

cision. Estes still has pending against him four more federal and state indictments containing more than 30 counts of theft swindling, mail fraud, false statements and criminal anti-trust violations.

Butler Is Next Foe For Tigers Two seniors and two sophomores are leading DePauw University statistical departments as the Tiger basketball team heads into the second half of its 22-game schedule later this week. Exuberant over its 87-71 upset win against Indiana Collegiate Conference foe Indiana State January 14. DePauw is confronted by league leading Butler Saturday. Tipoff time for the 83rd renewal of this series is 8 p.m. (CDT) in Greencastle. Butler holds a 58-24 edge.

Personal And Local News Briefs Donald Gorham is a patient in the Culver Hospital in Crawfordsville, where he underwent eye surgery. The Golden Circle Club will meet Thursday, Jan. 23rd, with Mrs. Etta Hinote for an afternoon meeting. A hot flue resulted in city firemen being called to 709 North Madison Street at 4:30 Thursday morning. No particular damage was reported. Mrs. Jessie Appleby of Cloverdale left the Indianapolis airport by plane Sunday for an indefinite visit with her daughter, Mrs. Lois Harrah and family, in St. Petersburg, Fla. Robert Norman Evans, 19, Fillmore, was arrested at 10:25 Wednesday night by City Officer Donald Twomey on I n d. 240. Evans was charged with an improper muffler violation. Dale Harrah, of St. Petersburg, Fla., flew to Indianapolis for a visit with his mother, recently Mrs. Sam Harrah. He visited other relatives in Putnam County before returning south by plane.

Tiger Wrestlers Win Over Valpo DePauw’s wrestlers pushed their campaign record to 2-2 last night with an easy 28-7 verdict over Valparaiso University. Aided by three forfeits in the 123, 157 and 167-pound classes, the Tigers copped two decisions, a fall and settled for a draw in the 137-pound division. Winners by decision were Fred Wendelboe, 147, and Ralph Larsen, heavyweight. Tom Charters picked up five points for his pin in the 177-pound class and 137-pounder Bill Danner got two points for his draw. A forfeit and the draw points accounted for Valparaiso’s final count.

Baby Burping Disrupts Court HOUSTON UPI —Percy Foreman, a burly defense lawyer, jarred proceedings at a pre-trial murder hearing Wednesday in di-

strict court.

He swung a 19-day-old infant into his arms with the deft handling of a mid-wife and burped it over his shoulder. District Judge Sam Davis, to whom Foreman had just said: “Judge, I’ve got to burp the baby,” sat open-mouthed, apparently too stunned to reply. Foreman was in court arguing with other attorneys whether

The infant was Mrs. White’s, and Foreman had asked Davis to invalidate her subpoena. She was brought to the hearing on a stretcher, and fed the baby from a bottle while lawyers argued. Training Plan Hits A Snag INDIANAPOLIS UPI—A plan to provide vocational training for about 600 persons in a state-owned building in Indianapolis has run into delay. Commissioner John Hatchett of the Indiana Department of Administration reported today to the Legislative Advisory Commission that the Department of Public Instruction seeks $127,000 to remodel and repair the building in the downtown section. The building formerly housed the Revenue and Employment Security Divisions of the state. Hatchett advised the commission that the budget committee had recommended that the matter be turned over to the Indiana Vocational College Board

West Floyd Club -Meets With Mrs. St. John West Floyd Home Demonstration Club held its first meeting Dec. 8 with Mrs. Dale St. John with 10 members present. Roll call was "Program I enjoyed most. Lesson I was Easy Entertaining given by Mrs. Arthur Eggers. Meeting opened with the history of the song of the month which was "Home On the Range” and sung by the club. The secretary's and treasurer’s reports were read and approved. Pledges to both flags were given. Gifts were sent to Mrs. Leroy Alters for her fiftieth wedding anniversary. She is in Florida at the present time. Her annniversary was Jan. 6th. Miss Grace Arnold had the entertainment. The next meeting is with Mrs. Ethel Ruark Feb. 12. Social hour, Mrs. Edith McKamey.
