’•Must I shoot a simple-mind-ed soldier boy who deserts

while I must not touch a hair of a wily uyi-

tator who induces him to desert?”

That was Abraham Lincoln’s pointed, open reply in 1863 to a congressman, Erastus Corning, and other New York Democrats in defense of the administration’s arbitrary treatment of anti-war agitators in the North and practical suspension of writs of habeas corpus. The president wrote in a similarly unyielding vein to M. Birchard and 18 other Ohio Democrats who protested extra-legal

measures taken against “Copperheads.’' Lincoln overrode rulings by Chief Justice Roger Taney and a resolution by Congress. The latter voted in March 1S63 that political prisoners either be released or subjected to regular judicial procedure. Political prisoners continued to bo detained without hearings; Fort Lafayette in New York harbor was full of civilians rounded up in New York by Union officers working with informers and local police. Because of the president's belief that preservation of the nation against collective subversion took pre-

cedence over individual civil rights, on Sept. 15, 1S63, Lincoln proclaimed new suspension of writs of habeas corpus where

deemed necessary.

Meanwhile, Lincoln remained considerate of contributing causes in cases of soldiers condemned in court-martial for cowardice, desertion, etc. As commander - in - chief, he intervened repeatedly when the sentence was death, or years of hard labor, and set aside on moderated verdicts in nu-

merous instances.
