Will Rule On Shop Contracts
INDIANAPOLIS. Aug. 15 — | (UP)—An Indianapolis judge may injure a decision today or. the legality of union shop con- ! tracts in a vital case that could lead to similar court tests
throughout the nation.
Judge Walter Pritchard of Superior Court indicated he would hasten his decision in anticipation of an appeal to the Indiana Supreme Court by the
losing side.
The suit, brought by Vernon i R. Smith of the Allison Division af General Motors, seeks a permanent injunction preventing the CIO United Auto Workers •.r.ion and the firm from enforcing the union shop clause o: uc-ii new contract. Smith, an non-union worker, said he instituted the action to protect the rights of a minority of about 700 other non-union workers in the plant. Should Smith lose the case, he would be required to join the union by August 26, when the terms of the new contract go into effect, or lose his job. Pritchard said a lower court ruling now would give the Supreme Court time to issue it‘ decision on the anticipated appeal before the Aug. 26 dead-
line.
Joined in the unusual role as co-defendants are the UAW and General Motors.

Anderson, attorney for General Motors, argued the economic employment of 37.000 GM employes :n Indiana” rests on the contract.
