Barger presided at the Indianapolis Negro truckdriver’s first trial when he was sentenced to die m the electee chair for the. shotgun slaying of Mrs. Mary Lois Burney. But a ruling Monday by the U. S. Supreme Court, stating that Watt’s personal rights were violated when a confession he made was obtained by police under duress, voided the death sentence. Marion County ProaocuYor George S. Dailey said Watts would be trif-d again for the Burney slaying and that he would hold "in reserve” another charge against Watts for the fatal stabbing of clubwoman Mrs. Maliel Mi rrifield. . Watts "confessed" both murders, but Dailey said he believ, d the state had a stronger cane ttirainst him in the Burney murder.
