employe, cabled him yesterday from the U. S. zone headquarters in Frankfurt requesting that he take over the ease. Bird fac“<l black market charges. Before leaving for Washington j by plane last night, Davis said he hoped to gain a writ of habeas corpus from the Supreme Court I demanding Bird’s immediate release. He claimed Bird had been 1 taken illegally from his home and extradited to territory outside the jurisdiction of a U. S District Circuit Court of Appeal. He said to insure the court's ability to enforce the writ, he would name Army Secretary Kenneth Royall as the person to , be held responsible for affecting
Bird's return.
Bird was arrested on blackmarketing charges in Germany . last year. He was released on < bond and managed to get out of I Germany and back to the United States before standing trial. He was rearrested at his home at Mishawaka, Ind., and according to Davis, held incommunicado for nearly two months al Fort Sheridan, 111., before being moved to Germany where he ar rived last March 31. During all this time, Davis said, Bird was not allowed the services of a lawyer. Davis said he believes the Su preme Court has jurisdiction in the case, which is “without prtedent.” If the Supreme Court does not accept original jurisdiction. he said, the writ woum r, filed later through the lower
courts.
