An application fer a writ of j habeas corpus to release Yama;.shlta was presented at the court’s I first session by Lt. Col. Walter : C. Hendrix, Atlanta, Ga., of defense counsel. I At the same time, other de- ' fenso counsel resumed efforts before the trial commission to prove Yamashita innocent of war' j crimes, and in court room No. 2 (seven Japanese defendants went 1 on trial before another commission on charges of murdering two American fliers and five Filipinos at Cebu City. I “We contend," Hendrix told the nine black-robed supreme I court justices, “that Gen. MacArthur has taken the law into his own hands, is disregarding ! the laws of the United States and the constitution and that he 1 ' has no authority from Congress ' or the President “He is a great soldier and General but not a great lawyer. His orders regarding this ease are

illegal."
