This claim of Mrs. Thompson was contested by the other heirs, and, on their petition, the court appointed John H. James to represent them in their action against Mrs. Thompson, on their showing that the claim was excessive. That complaint is pending in court. In setting out their contention that the alleged carbon copy of the will now being offered for probate is genuine, the complaint filed Saturday states: On October 26. 1928. the decedent executed her last will and testament and hail possession of it up to a few weeks before her death: that about December 1. 1936, she mislaid or lost the will and was unable to find it; that after making a diligent search for it. she expressed a desire to rewrite the will, as it was first written, if the original could not be located: that during her lifetime she never revoked the original will, nor intentionally destroyed it. nor caused it to be destroyed; a dilligent search has been made since decedent’s death to find the will but the original will could not be found: plaintiff says that decedent’s lawyer, Fay S. Hamilton, of Greencastle, one of the subscribing witnesses and the scrivener of the will, when writing it. executed a copy of it and retained it among his office papers; that said attorney, after a long and diligent search for the copy of the will, found it among his office papers, after decedent’s death and after plaintiffs had been appointed administrators: the plaintiffs aver they now have said copy of the will in their possession and it is a carbon copy and verbatim copy of the original will. The plaintiffs further show that
the decedent is survived by the plaintiff, Albert J. Cline, a brother; also the plaintiff, Nellie M. Thompson, and other nephews ajnl nieces as her sole heirs, and that Mr. Cline and his daughter are the beneficiaries in the lost will. Wherefore, the plaintiffs as legatees under the wilt ask the court to establish the copy of the will as the last will and admit It to probate, and that Mr. Cline and Mrs. Thompson be appointed administrators under the wilt F. S. Hamilton and M. J. Murphy are attorneys for the plaintiffs.
COMMUNIST JUBILANT OVER G. M. C. STRIKE
MOSCOW. March 22—(UP) —K. Redmill, writing in the Communist International Magazine No. 2. today praised the “work of Communists in the General Motors strike” at Detroit and Flint. Mich. “During the entire strike,” he said, “Communists were active in a leading role. They conducted many-sided work in helping strikers, collected money and carried out demonstrations of solidarity. “The Communist Party through its central organ, the New York Daily Worker, gave advice on how to conduct the struggle and in many instances this advice was adopted.”
CIRCUIT COURT NEWS The possession suit of the Prudential Insurance company of America against Dean Wehner, filed originally from Morgan county June 17, 1933, but dismissed for want of presocution December 22. 1933. and later refiled, was called in the Putnam Circuit court Monday morning. Lydick has filed a partition suit naming Maggie F. Lydick as defendant, and on Monday the petition to sell the property on the grounds that it is undividablc was granted, and permission given to sell tho property.
