March 10 (UP) — Enactment of President Roosevelt’s judiciary reorganization program would be “a death wound to the independence and integrity of the judiciary,” Rep. Samuel B. Pettengill, D., Ind., told the Committee of One

Hundred last night.

The Indiana congressman, speaking at about the time the president was delivering his fireside chat to

the nation, asserted:

‘•The argument that the supreme court is a barrier to progress is a cruel hoax and leads the ignorant masses of America to believe that tlie government will knock plums off

the trees for them.”

The supreme court is "utterly defenseless,” said Pettengill. "You won’t hear Chief Justice Hughes on

the radio tonight.”

URGES COURT ACTION iTontinned From I*nire One) 17 other senators comprising the ju-

diciary committee.

As the big legislative show of 1937 begins the 18 senators— and the senate itself—are divided. Seven committeemen are against; six are for; and five are uncommitted on reorganization. That committee division reflects fairly accurately the division of the senate as a whole. It was to the senate as well as to the public that Mr. Roosevelt spoke last night, charging that the supreme court majority has been both bold and improper in “assuming power” to pass upon the wisdom of acts of congress. “In the last four years,” he continued, "the sound rule of giving statutes the benefit of all reasonable

doubt has been cast aside. The court ders of Bellville spent Thursday has been acting not as a judicial with Mrs. Henry Osborn.
