tory order, and appellees have moved to dismiss on the ground that it does not come within the statute, as the several amounts required to be paid are not set out in the order, but left to computation but such motion is overruled. After giving the specifir bequests to first be paid, a legacy was provided to the Y. M, C. A. of $1,000 and then the residue given to Wabash College. "As against residuary legatees, specific legacies will draw interest after the expiration of a year from the date of the death of the testator,” The appellants contend that the rule applies only to the residuary legatee, and not against the Y. M. C. A. gift, as it was not a residuary gift. But the court says that the will provides that the other gifts should be paid first, and so they stood in preference of the Y. M. C. A. gift the same as though it were the residuary gift. The will is not so worded as to permit the executor to hold and manage the estate to increase it, for the purpose of paying the gifts which the will provided should be paid only if there were sufficient money left to pay them after paying the first gifts. Delay for the purpose of being able to sell assets at a better price are beneficial only to those gifts which stand second to the gifts which are to be first paid, and cannot deprive the preferred legatees
of interest on their gifts.
