Dutton, quo warlanto proceedings for the office of secretary of the county board of health, was here yesterday and rendered a decision in favor of Dr Breedlove. The court held that parole evidence was not admissable to show appointment. The ruling was on the ground that there is no record of the appointment of Dr. Dutton, nor of

Thieves entered a pasture belonging to Charles Robards near Stilesville recently and stole eight of his hogs. Lemmon Bailey, a tenant on the Robard farm, heard the noises made by the thieves and hogs and investigated to find a truck in the pasture and the men loading the hogs. Dr. Dutton declined to turn over the office on the ground that his term nad not expired. Proceedings were brought in circuit court by Dr. Breedlove to obtain possession of the office and a change of venue from judge was taken, Judge Flughes being appointed. The hearing developed the fact that no record of the appointment of Dr. Dutton* appeared on the records made by the county auditor. Dr. Dutton, however, had notice from the state board of health that his appointment had been certified to that board by the county auditor and the county commissioners also testified to the appointment. However, this evidence was not sufficient, and because of a failure to record the appointment, and oath, the court ruled against the de-
fendant.
