duce local levies, hut not* increase them, the court said. The case was an appeal taken by Philip Zoercher and other tax board members from a decision of the St. Joseph Superior court in which the state board's jurisdiction was demied in reducing by one cent a 73-cent levy made by the city of South Bend One of the unusual features of the case wa« that it was instituted by i Robert X. Alger and other South Bend Taxpayer- who demanded the right to pay the 73 rather than 72 rent levy. The tax hoard made the one rent reduction when it was disclosed that the higher levy was based on a S188,000,000 valuation and should have been based on 8191,000,000. It was pointed out that 72_cents would he. sufficient to cover all proposed hufget expenditures Walter Arnold* South Bend attornry argued the appeal against the tax board on the basis of “Home Rule”. He told the court that the tax board was unconstitutionally usurping a legislative function in passing on the

levies.

But today’s opinion, written by Justice Clarence R. Martin, upholds the constitutionality of the 1927 statute giving the tax hoard this

power.
