SI ill Under IMHh Sentence According to law, Herron still is under the jurisdiction of the Middle '•x County court. 'Twenty years ago, after a sensational trial, in which Herron's .-unity was questioned, his execution was stayed “until the further order of tlie court” by the lute Supreme Court Ju-tioe James J. Heigeu. Justice Bergen, who pronounced the sentence of death on Hetron after the jury hail returned a verdict of first degree murder, was positive that the murderer wa-s insane: at the time of the crime. Two reprieves were granted end two -lays were allowed, the lust one virtually making Hetron a life prisoner, although in the eyes of thr law he is still guilty of minder, if sane. Herron was sentenced July 8, 1908, and received at the state prison July 31 to die in September, 1908. Cancels Governor's Death Order A new sentence was imposed on Jan. 25, 1909, but the late Governor John W. About an hour and a half after the Governor’s order reached the prison, Justice Bergen issued an order for an inquiry into the mental condition of Herron and on June 2 following directed another stay stopping all proceedings until further older of the court.
