The lowdy bedbug now finds itself the cause of a suit for fraud in the
Marion County Superior Court. “The uBttle of the Bedbugs,” might
be the title of a little drama recited in the petition, or it might be "The j
Charge of the Bite Brigade."
It was enacted, so Jes-e Rupert j Smith complained at a house which he had leased with the specific under standing that there were none of the
pesky bugs on the premises. Moving in last September, after
paying $25 rent, he found quite the contrary to be true, he complained. The result was a night battle lasting more than two weeks, waged nightly, a.id often during the day and resulting in a ghastly casualty list.

on the second lloor. Attempts to take the “tort” preyed futile, Smitb and Ills “attackers” being repulsed each time they neared the top of the stairs. It developed into a sort of “guerilla warfare,” but lo- es con
tinued heavy on both sides. Finally Smith withdrew. Instead
of calling for “reinforcements," he called a drayman, silently crated Ids furniture and stole away into the
night.
Now he brings suit for $80, alleging he was defrauded out of the $25 n nt, and was put to the expense of moving in und out of the house.
