Diabolical Attempt to Murder. ,^Frora Mr. A. 0. Hough, Mail Agent on the Terre-Haute & Richmond Railroad, we learn that as the Night Express Train was coming over, last night, when some mile and a half or two miles this side of Brazil, some fiend, shot at the Engineer, Mr. Idler, the ball striking the bell on the Engine, on a perfect range with Mr. Idler's bead. The Train was running very slowly at the time, which fact probably saved his life. The ball left its impression on the bell, fairly leading it over, and gave out peculiar ringing sound heard by all the passengers.

Our readers are aware of the existenceofalaw in Indiana prohibiting, under penalty, any negro or mulatto from entering the State, Jas. B. Brown, a free colored man, of Ohio, traveling westward, stopped at Fort Wayne, when he was arrested, fined ten dollars and costs, and, in default of payment sent to jail, A writ of habeas corpus being sued out, Mr. Case, a lawyer, ap-
for the prisonar's discharge. "The statute," said he, "designates 2*wo classes of persons, and only two,

prohibited from coming into
^the State, viz: Negroes and mulattoes, ll^and being a highly penal statute, every word and sentence of it must be strictly construed.'*- Adopting this rule, only a full-blooded African, or his descendants and a half-blood—half white and half black blooded—are excluded by the statute and when a prosecution is instituted under it the State must prove what she alleges, viz: in this case, .. that the accused is a mullatto.
Mr. Carson, on behalf of the Slate,
^pllinsisted at length that the intention of the makers of the constitution and the VL Legislature was to exclude all persons of jnore than one-eighth negro blood, and
that this was evident from the statutes "prohibiting such persons from giving ., testimony and from intermarriage with whites
Hi* i-on-iir Judge Borden then delivered his opinion, nolding the construction of the statute contended for by the prisoner's counsel to be correct, and that pthe State, having failed to prove Brown to be a mulatto or negro, he must be .discharged. Ordered accoidingly.

learn that Mr, Fillmore is having'the most brilliant success in English society. His fine personal appearance and graceful and dignified manners contribute quite as much to this, as bis political distinction. Queen Victoria eays he is the politest American she ever saw, and all manner of Dukes and Earls are inviting him to their country seats. He is accompanied, as Private Secretary, by Honry E. Davis, Esq., formerly Counsel to the Corporation of New York, and author of a legal work on the Corporation Ordinances. The Know Nothing journals of the South, are nominating Mr. Fillmore for President.—Xew Yok Tribune.
Within the last few days it has been discovered that a large amount of wellcxecuted ten dollar counterfeits, on the Bank of Montgomery county, Pa., havo been put in circulation. It is thought a largo number of tbem havo been sent through Ohio. It would be well to look out for them.
