AO.VlES r.ow the plaintiff by Thompson and Scott., his attorneys, and on motion ordered that the Judgement heretofore taken against the defendant Gibsen, be net aside, and it appearing to the Court from th return of the Sheriff to the process herein, that the defendant James Gibsen, was not found. It is then-fore ordered by the Court, that the said Jsmes Gibsen, be and appear in that Court, before the Judge thereof, at it* next term, to be held at the Court House, in TerreHaute, on the first Monday of October next, on or before the calling of the cause for trial, and plead answer or demur to the plaintiffs complaint, or the matters and things therein contained, will be heard and determined in his absence, and this causc as to the said James Gibsen, is continued.
