and Scott, his attorneys, and on motion ordered that the Judgement heretofore taken against the drfendaiit Gibson, be set aside, and it appearing to the Court from the return of the Sheriff to the process herein, that the defendant James Gibsen, was not fou 11 d. It is therefore ordered by the Court, that the. said James Gibsen. be and appear in that Court, before the Judge thereof, at it next term, to be hfld at the Court House, in TerreHaute, on the first Mondiy of October next on or before the calling of the causo for trial, and plead answer or demur to the plaintitF-'s complaint, or tho matters and things therein contained, will be heard and determined in his absence, and this cause as to die said James Gibsen, is continued.
