THE JURY niSCHAUGEO VYITH OUT A VESDICT.

CflARGKS

GKS OF TAMPERING

WITH A JURYMAN.

LUCELLUS, BRING

FORTH

: The "WMte Cap" case yvas given

to the jury last Friday night. J uUge

ifiers, in Lis closing address, charged that the jury had been tampered with by the defendants, which hold assertion created quite a sensation i in the Court room; When Judge Pearson charged the jury Friday night, he spoke of the charge and said that was a matter for investigation after the case had been disr . posed of. Perry Bo tcher; a juryman, arose in his seat and disked to be permitted to explain, but the - Judge refused to allow him to do so tintii the charge properly came p

for investigation. The jury retired

about 8 oTdock and nothing was

heard from them until Saturday Afternoon when they came into onrt anduasked for further instructions. As they did not want any information on points of law, the J udge could not help them- any so sent them back to their room.-They V were again shut up, but furnished with three good, square meals a day nntil Monday afternoon when they ; again came into court and an- .: nounced that they could not, possibly agree on a verdict; they were ? then discharged, having been out r about 56 hours. When they first ? went out they stood six and six.The defendants then gained until the

last ballot, which stood eight for the plaintiif and four for the defendants. All of the jury was in favor of acquitting some of the defendants, but the four who stood ' firm were determined to fix the guilt especially on John Carson, Hez. Knrraon and Marcus Reed. It is said that the charge ' of tampering with the jury was founded on ; information that John Carson had been drinking the night before, in Jim Kelly's saloon, with juryman

Butcher. Butcher, it is so reported,

was a long, tedious and expensive one, and it ever tried again, will probably be venued to some other county. In his charge to the jury Judge Pearson wisely said : . fWhtteicap law,.so called, is but the outgrowth of a viscious public 6entiment-tne outcropping of ignorance and selfishness, and can only be applied successfully against the weak anddefenselessto whom the law- would extend theis ime rights as it does'thft most powerful of the land. If - such a .system - is given any. quarters in a community- and an influential or wealthy citizen .by chance shall feel its power, then we at once see that such community becomes divided, and courts

will become powerless to punish anybody r under the protection of such factions." - la his closing argument, in making the charge that an attempt had been make to tamper with a juryman, Judge R.-W. Miers said : ttIt has been reported on the streets that this jury, since it was impaneled, has been tampered with with my co-counsel in this case after the cause has been finally disposed of, we-stand ready to submit such facts as have come to our knowledge upon which this statement is made to the H Court , for its determination and such action as. may be deemed proper in the premises. It has been reported to us that one of this jury so forgot himself and the instructions given by you r honor as to be seen at a late hour

of the night under peculiar circum- : ' stances-with one of the defendants ;

that one of the jurors and one of the defendants were seen together in or near a saloon and under such circumstances as would lead me to i infer they were drinking together. Perhaps nothing improper was in- . tended, but as a member of this bar, as a man who desires the enforcement sf the law and the vindications of court, I .desire that this patter may be investigated that the truth may be known and no injustice done. : , Jt seems that the matter was dropped, however, as there was no open

investigation; probably on account r of the accused juror Perry Butcher, f -voting- for conviotion. It is said T p. that Norman will now push a crim-

nal prosecution against the defend4 - rit8.'-, ...
