Court News— ASK SB,OOO National Plywood, Inc., of Chicago, has filed a complaint on a note in circuit court against Cristecon Industries, Syracuse. The plaintiff alleges that a $5,000 promissory note signed 18 Nov. 1953 is wholly due and unpaid. Judgment of SB,OOO is asked. The amount includes $1,500 in attorney fees plus five per cent Interest. ASKS SEPARATION Lucy B. Kegg has filed in Kosciusko (Circuit court a complaint for separate maintenance against Walter M. Kegg. Route 1, Ligonier. The plaintiff alleges habitual crelty. Married Feb. 1. 1928; the copule separated May 16, 1956. TO BE ARRAIGNED ’ The arraignment of Marvin E. Kuhn, on failure to support four children under 14 years- of age. haa been set for 9 a. m. 13 Jiine in circuit court. The affidavit was signed by Kuhn's wife, Betty. DIVORCE GRANTED Marlene Hiner, of Syracuse and Pierceton, received a divorce from John Hiner. The Hiners were married March 11. 1953, and they separated July 27. 1955. SET TRIAL Robert L. Dust. 26. of Syracuse, waived arraignment and pleaded not guilty to drunken driving', in an appearance before Judge Seth E. Rowdabaugh in circuit courtjDust requested a joiry trial which is scheduled for 26 June. Wallace Manrow. state trooper, arrested Dust 21 April on Ind. 13 in Turkey Creek townskip and took him to the court of Wilbur Gill, justice of the peace. At that time Dust declared he was innocent and asked that the case be transferred to circuit court. FINED IN GOSHEN COURT Elden Swartz. 32. who failed to appear for a scheduled jury trial 5 June pleaded guilty Thursday night in Goshen city court to a charge of driving an auto while under the influence of intoxicants. Swartz was assessed a fine and costs totaling $52.75 by Philip C. Barker, who also revoked Swartz’s driver’s license for one year. IN GOSHEN CITY COURT Three Syracuse men will face charges in Goshen city court as the result of their being arrested just north of the city on State Road 15 Sunday night. Clarence McKibben. 51, was charged with drunken driving and his two passengers. George H. Doty. 61, and Charles Weaver, 66, with public intoxication. An off-duty Goshen policeman said he saw McKibben’s car weaving across the highway and he alerted othe» officers who made the arrest. Obituary.... HIRE Mrs. Henrietta Hire, 94. died at the | Bradbury nursing home tn Warsaw Monday evening at 8 o’clock following an illness of three months. Death was due to complications of old age. Mrs. Hire, a lifelong resident of tht Syracuse community, was born Nov. 2. 1861 to Mr. and Mrs. John AWeaver. In 1882 she married James Alonzo Hire who preceded her in death in 1942. She was a member of the Lutheran church at Syracuse. Surviving relatives are two sons, Roy and Marion, both of Syracuse; and a daughter, Mrs. John (Leia) Mench. also of Syracuse, five grandchildren. and nine great grandchildren; a half-brother. John A. Weaver, of Mishawaka. Funeral services were held at the Lutheran church today at 2 p. m. with Rev. Carl Sorenson, assisted by Rev.Kenneth Foulke. officiating. Burial will be at Hire cemetery west of Ligonier. - SEARFOSS Mrs. Alice Searfoss, 76. died at hsr home suddenly at 11 p. m. Monday. Mrs.' Searfoss was born in Syracuse on March 23. 1880. to David McGarity and Sara (Ruple) McGarity and had lived all her life in this community. She was married to Frederick Carl Searfoss who preceded her in death in 1951. Surviving relatives are two sons. Alden Himan. and Alva D. Searfoes, both of Syracuse; a daughter. Dorothy (Mrs. Allen) Ritter, of Syracuse; 14 grandchildren, and 19 great grandchildren, one brother, Elmer McGarity. of Syracuse: and one sister, Katherine Metzer. of Goshen. Funeral services were held at the Harris funeral home in Syracuse. Thursday at 3:30 p. m. with Rev. John Jones, of Union, Mich., officiating.
