Stream Pollution Control has jurisdiction over any person or business contaminating any stream in the state but confines its activities to municipalities and legal corporations. Carter said such things as septic tank pollution cases are referred to respective county boards of health. “We just don’t have the money or personnel to police everything,” Carter lamented. Robert Jackson, chief of the water division; Victor Wenning, his assistant; and Gordon Lance, head of the planning section, coordinate the agency’s concerns for Eagle Creek. The men have used date from their own studies and the U.S. Army Corps of Engineers to prepare mips showing flood planes for both the “100 year

flood” and the “standard project” flood. Any construction which takes place in the area which would likely be covered in the “100 year flood” must receive a go-ahead from the Water Division. The “100 year flood” is based on probability studies. Eagle Creek’s 1957 rampage is rated only a mere “25 year flood.” In other words, the 1957 flood has tiie mathematical probability of happening every 25 years. In Marion County, an plans for development are checked before the issuance of an improvement location permit. If they happen to be located in a flood plane, they are sent to the Flood Control Board. There, engineer Roger Pate works closely with the Water Division personnel to make certain a developer’s plan will not affect the flow of water along Eagle Creek.
