Commission reports, as I have often observed and noted in these columns, frequently die rapid and timely deaths. After all, the spectacle of men who would go into nervous twitters of trembling at the click of a mouse-trap passing judgment on what should be done with firearms, for instance, or seeing what should be a serious, objective study of a problem turned into a harange concocted by the commission and staff, gets somewhat old and tiresome. But I would venture to predict that a forthcoming commission report, far from dying as such from lack of attention, will have somewhat the same effect as a match in a pail of gasoline. Not what its authors intend; if preliminary reports on what the President's Commission on Pornography will submit are correct, the effect will be on

This is a case where the shell bursts before leaving the muzzle; not only is the target left untouched but the field piece itself, as well as the crew, are obliterated. Only bits and pieces have leaked out, but he report is said to contain a recommendation that all obscenity laws be scrapped, and to come to this truly astonishing conclusion: “Most Americans, both laymen and professionals, do not regard erotica as a matter of prime national concern, nor is there a consensus that its use is potentially harmful for the consumer or for society." Or this one: ‘There is no evidence to suggest that exposure to pornography has a detrimental impact upon moral character, sexual orientation

see some very hard laws indeed come out of the Congress and the State Legislatures. People will simply demand them. It is argued that pornography does not have a specific definition as yet. Well, to this I can only say, then ft is the duty of the Nation's lawmakers and jurists to come up with one, and enforce it! It has gone farther than we think. There are 18 members of the Commission; only one was appointed by President Nixon (the Commission was created before Nixon took office) and he wrote the White House last on July 14 of this year, enclosing three staff-drafted commission reports. Know Your Indiana Law

In the general election in November of 1970, the citizens of Indiana will be asked to vote upon some very important amendments to the Indiana Constitution, ft is necessary that two successive sessions of the General Assembly approve a constitutional amendment before it is submitted for approval or disapporval by a referendum of the voters. This week I will discuss the amendments concerning the Judicial Article of our Indiana Constitution. This amendment will provide a new method for the selection of Supreme and Appellate Court Judges. Presently our Supreme and Appellate Court Judges are elected in the regular partisan election after having been selected as nominees by their respective parties. The proposed amendment would remove the election of Supreme and Appellate Court Judges from partisan political elections. Under the proposed amendment a nominating commission consisting of three attorneys selected by the legal profession, three lay members appointed by the Governor and the Chief Justice of the Supreme Court would evaluate the condidates for these posts and submit three names to the Governor of Indiana. The Governor would then be obligated to appoint a judge from the three persons submitted. That judge would then serve for a period of no longer thatn three years when he must come before the citizens on the question of whether he should be retained in office. This would be accomplished at a non-partisan election in which the judge would be presented to the voters on the basis “Should Judge Smith be retained in office? Yes or No." If the voters say yes he should be retained in office, then Judge Smith would serve fora period of ten years at which time he would again come up for a vote for bls continuation in office. John J. Dillon lection process and a new judge is appointed. All of these elections would be of a nonpartisan nature without any political party label and without any opposition candidate. The Judicial Nomination Commission will also serve as a disciplinary body to provide for both administrative removal of a judge unable toperform his duties and disciplinary removal by initiating action before the Surpeme Court to determine whether a judge should be removed for persistent failure to perform his duties. This proposed Amendment will in no affect local trial courts which will continue to be elected as they are at present on the political party ballot. It is, however, an important change in our Judicial System, and the first basis change in the Judicial Article proposed since the adoption of our Constitution in 1851. Copyright 1970 by John J.
