Possessors of Marijuana Subject to Tax Indiana State Police officials have found what may prove to be an effective deterent against the unlawful use and possession of marijuana. Superintendent Robert K. Konkle reported this week that Department researchers recently discovered a seldom-enforced section of the Internal Revenue Code of 1954, enacted by the Congress of the United States, entitled “Marijuana: Imposition of Tax on Transfers.” Briefly, the portion of the code referred to rules that whenever marijuana is transferred there is a tax due the Federal government of one dollar per ounce for persons who posses a valid Federal narcotics tax stamp. The code states further that in a similar transaction by persons who do not have a narcotics tax stamp, an assessment of SIOO per ounce shall be levied by internal revenue authorities. Only druuggists and doctors are permitted to purchase the narcotics stamp. State Police crime loboratory experts pointed out that an average marijuana cigarette has a tobacco weight of about 1/20 of an ounce. Any measurable part of an ounce shall be considered an ounce for taxing purposes, according to the wording of the

code. Therefore, Konkle emphasized, a person in possession of just one marijuana cigarette would, in * ddition to criminal penalties, be subject to payment of the SIOO tax. State Police conferred at length with internal revenue authorities to establish validity of the code and to set up procedures for reporting the identity of those persons apprehended and charged with illegal possesion of marijuana.. State and Federal officials added that offenders would, as usual, retain the right of appeal in the appropriate tax court. Superintendent Konkle pointed out that the tax assessments will be levied even in the case of juvenile offenders. State Police plan soon to contact all other Hoosier police agencies to explain the legal steps necessary in notifying the Internal Revenue Service when apprehensions are made.

The event is free and open to all children. Experiments and demonstrations in the museum’s science gallery are also on the Saturday schedule. They will be at 12 and 2 o’clock. After school activities at the Children’s Museum will continue this week with crafts at 3:45 on Tuesday and Thursday, and museum games, stories or gallery talks on Wednesday at the same hour.
