ORDINANCE 334 (Continued from Page 1) health hazards; and WHEREAS, trash on public ways and facilities not only may threaten public safety but also is detrimental to appearances; and WHEREAS, a town may be known by its appearance and it is consequently in the public interest for the Town of Speedway to have the best possible appearance; and WHEREAS, an emergency exists for the passage of this NOW, THEREFORE, be it ordained, by the Board of Trustees of the Town of Speedway, Indiana: Section 1. No real property owner shall permit his real property which abuts on a public way to become unsightly, unclean, uncanitary, obnoxious, or generally offensive to users of the public way. Violations of this section include but are not limited to allowing accumulation of litter or waste, allowing unchecked growth of grass, weeds, or other vegetation, or allowing houses, buildings or other structures to remain in a state of disrepair.

Section 2a. The Board of Town Trustees may order the reel property owner to correct conditions which are unsightly, unclean, unsanitary, obnoxious, or generally offensive to users of the public way. 2b. If the real property owner fails to comply with such order within the time prescribed, the Board of Town Trustees may have the conditions corrected and place on the owner’s real property a lien for the cost of correction in accordance with the statutory procedure provided for weed cutting in the Town; and such owner shall also be liable for the fine hereinafter prescribed. Section 3. No person shall place or throw any paper, organic waste, or trash or refuse of any kind on any public way, including sidewalks and streets, or other public facility, including parks, in a manner and to an extent that would render the way or other facility unclean, unsightly, or unsafe. Section 4. Any person who violates the provisions of this ordinance is liable for a fine not to exceed SIO.OO and each day’s violation is a separate offense. . Section 5. Since an emergency
