Election Laws Of Indiana The State Election Board composed of Matthew E. Welsh, Edwin Steers, Sr., and James E. Noland, all lawyers, has just issued its 1962 edition of “Election Laws of Indiana.” On Page 5 of this book appears the following: “The state election board of Indiana by adopting a Resolution has established Central Standard Time as the time under and pursuant to which primary and general elections in the State of Indiana shall be held and conducted; and further ruled and ordered that any and all matters and things in connection with the holding of primary and general elections in the State of Indiana be conducted on Central Standard Time. On May 19, 1962, the Johnson Circuit Court entered a Declaratory Judgment directing County Clerks in 43 counties in Eastern Indiana operating on Eastern Standard Time by order of the Interstate Commerce Commission of June 6, 1961, to conduct this election on Eastern Standard Time. The State Election Board is appealing such judgment and will advise the County Clerks involved about the status of such appeal and standard of time for holding the 1962 General Election in their counties in ample time to meet deadlines in the 1962 official political calendar.” Which statement was only placed in this book at the insistence of Mr. Kurt F. Pantzer, Jr., the attorney representing the plaintiffs in the Johnson County action. However, on Page 50 under the sub-title, “Opening the Polls,” the book contains the following statement:
“Six o’clock a.m., Central Standard Time, is the hour fixed by law for opening the polls, and this provision is mandatory.” Again, on Page 51, under the sub-title, “Polls Open Continuously” appears the following statement: “The polls must b,e kept open continuously from 6 a.m. until 4 o’clock in the afternoon, Central Standard Time after which the Board may close the election at any time when all the electors have voted .. .” Again, on Page 68, under the sub-title, “Closing Polls,” appears the following: “The polls should stay open until 6:00 o’clock P.M., Central Standard Time unless the precinct election board decides to close them at an earlier time as provided by statute.” In view of the finding of the Johnson Circuit Court, which is and remains the law of this State until reversed by a higher tribunal, the three above-mentioned statements are absolutely false and are a flagrant deception by a supposedly responsible State Board composed of three lawyers. The statement appearing on Page 50 “Six o’clock AM, Central

Standard Time, is the hour fixed by law for opening the polls and this provision is mandatory,” is a particularly false and misleading statement, and it can only be taken as an example of the depths to which this Democrat-controlled, bureaucrat Board will go in its determination to force its chicanery on the people of Indiana, even though in direct violation of an order of a court of competent jurisdiction whose order as it now stands is the law in the State. The clerks and election boards in the 43 counties comprising the Eastern Time Zone should be apprised of these false and misleading statements in what is supposed to be an official publication of the State Election Board. Marion County, for one, will follow the law as directed by the Johnson Circuit Court.
