THK trial of John Hmltb tor killing Bartholomew Foley was commenced in the Criminal Court on Monday. Judge Carleton asaistedin the prosecution and Davis ,t Davis and Judge MoNutt appeared for the defense. A jury was impanelled, but the evidence was not all in when the prosecutor gave up the ease and Judge Long instructed the Jury to return a verdict of not' guilty— a very proper proceeding as we understand the circumstances of the affair In which Foley received his death wound.

SOME MORE HISTORY.
