Court Restrains F.C.C. Ban On Radio Giveaways CHICAGO, .Sept. 13 (UP) Federal District Judge Michael L. Igoe today issued an injunction temporarily restraining the Federal Communications Commission from putting its proposed ban on radio give-away shows into effect on Oct. 1. Igoe ruled that the temporary injunction shall be in effect until a three-judge constitutional court rules on the proposed ban. He set Oct. 7 for the start of hearings bythe three-judge court. The injunction was issued at the request of Radio Features, Inc., which sought the convening

! of the three-judge court on

grounds that the FCC ban was unconstitutional Attorneys for Radio Features argued that the FCC action deprived- radio stations and networks of property without due process of law.

, Similar Suits' -have been filei

in New York on behalf of the American Broadcasting Co., the Colum'bia Broadcasting System, and the National Broadcasting Co. The Chicago suit was filed first. i Igoe in issuing the preliminary injunction said he issued it on ' grounds that "irreparable" damage might be suffered by the radio stations. During arguments preceding Igoe's ruling, Attorney Max Golman for the FCC said he did not believe there was need for the injunction. He said he did t ot think that there was any possibility that a station wouM lose its license jf it carried give-away programs after Oct. 1. The commission, he said, would be inclined to await a rulin; by a three-judge court, and no license renewals were iu thi off

ing for hearing until Nov. 1. Mainly, Golman argicd, tha

commision did not feel that a

single judge should isr.te an injunction when tha FCC ruling demanded a three-judge court for interpretation. Igoe, how

ever, said that the petition of Radio Feature was in good or

der and p'roper.

OBITUARY Maggie Fylura Foutz, daughter of Absalom and Nancy Jane Patton Foutz, was born April 14, 1896 in Turman Township in the family homestead where she spent her entire life. She was one of eight children: namely, Calvin, Mary, Jacob, Byron, William, Durham, Fylura, and Carl all of whom survive her. Her illness was of long duration and her suffering was ofjten intense. Last May, she went to Methodist Hospital in Indianapolis where she received the best of medical treatment and surgery, but it was all of no avail, and she gradually grew worse until on last Friday, September 2 she slipped away to that eternal Home "where sickness, nor sorrow, nor death ever comes" at the age of fifty-three years, four months, and nineteen days. On her return from Methodist Hospital she went to the home of her brother, Will, where she was tenderly cared for by her sister Mary, and Will and his good wife. Early in life, under the pastorate of Rev. Brimlow, Fylura united with the Methodist Church at Union Chapel and remained a

loyaLTmeiiiher always-failhfuLia. attendance as long as her health would permit. She filled different offices in the Sunday School, serving as teacher of the Primary class for a number of years. On August 1 on her sick bed, she came into a full knowledge and experience of our Lord and Saviour, Jesus Christ. On that day, God did so wondrously bless her and give her such a glorious assurance of salvation, that she went to her Heavenly Home rejoicing in the Saviour's love. She is survived by the sister and brothers already named, by her friend Hurshel Huff, eighteen nieces, eight nephews and many other relatives and friends. CROSSING THE BAR Sunset and evening star, And one clear call for me! And may there be no moaning of 1 the bar When I put out to sea.

But such a tide as moving seems

asieep Too full for sound or foam, When that which drew from out the boundless deep

lurns again home. Twilight and evening bell, And after that the dark!

And may there be no sadness of

larewell, When. I embark;

For though from out our bourne

ot time and Dlace

The flood may bear me far, I hope to see my Pilot face to face When I have crossed the bar.
