NEW YORK, Sept. 8 (UP) Attorneys for 11 U. S. Communist leaders charged with conspiracy failed today in an attempt to have a mistrial declared on the basis of the rioting which followed Paul Robeson's concert at Peckskill Sunday night. But Judge Harold R. Medina left the way clear for defense attorneys to apply to another Federal court for an investigation of the attack on the Roleson supporters by irate, antiCommunist townspeople. The mistrial motion charged that the Peekskill melee had prejudiced the defendants' righ-s to a fair trial and that the stones pnd bottles thrown at some of the defendants violated their Constitutional right.? - An Ontr:;e "I think it was outrageous and no question about it, ' Medina said. He refused to consider the mistrial motion, however, on the ground that the affair "has no concern with this trial and should not be permitted to become part of the trial." The defense then moved for a Federal grand jury investigation of the incident. Medina refused to interrupt the trial by involving the court in such an investigation, but " told the attorneys they might renew their application in the regular criminal term of the court. Medina rebuked the attorneys
for attemping to delay the trial. Rebukes Attorneys "This is not the first time the defense has tried to get the court to investigate something or other," he said, "all of which is'

WASHINGTON, Sept. 8 (U.R) Sen. Scott Lucas, D., 111., said today the Senate will pass the administration sponsored reciprocal trade extension bill without an amendment which Republicans say is a safeguard against dangerous tariff cuts. The Democratic leader conceded the vote "'could be clos"
on the amendment by Sen. Millikin, R., Colo. The amendment would require, the President to report to Congress whenever he
cut3 tariffs below danger points set by the tariff commission. Millikin's peril point provision was writtten into the reciprocal trade act by the 150th Congress. The Demo-craic 81st Congress seeks to remove it from the proposed three year extension of the act. ; Sen. Arthur H. Vandenberg, R., Mich., who helped writs in the peril point? provision last year, dismissed as "ridiculous" the administration's opposition to it.
