Screen Snapshots - News State Treasurer Clarifies Recent Gross Tax Ruling INDIANAPOLIS, Ind., Jan. 2. (Special State Treasurer Frank T. Millis today issued the following statement concerning . the payment of the Indiana : Gross Income Tax on receipts from the sale of securities during the 1946 calendar year: ... : "Officials of the Gross Income Tax Division advise that the recent decision of the United States Supreme Court in the Freeman Case, relating to the taxability of gross receipts from the sale of securities, is confined to, a special and specific set of facts; and therefore, that the decision does not apply to all types of sales of securities. "In no event will refunds be considered by the Division until the Supreme Court's decision on a petition for re-hearing, which will be presented, is received. In the event that a re-hearing is denied the Division then .will I formulate a rule or regulation in respect to refunds. "It is mandatory for all taxpayers to report their entire gross income and then to take deductions on items, which are nontaxable. PEORIA, 111. (UP) Acting 1 Desk Sgt. Pett Combs answered the telephone at police headquarters. "Hello, police?" asked a child's voice. "Yes," said Combs. 'Santa Claus didn't leave me a train and a tractor I ordered, receipts from the sale of securities for the current year subject themselves to the payment of interest at the rate of one per cent per month plus penalty on deficiency ns provided by law if the deduction later is found to be Incorrect and that deductions taken arbitrarily at the time the return is filed is done so at the taxpayer's own risk. "In cases qf questionable immunity from the tax, the law provides that the taxpayer shall pay the tax and then file a petition for refund within three years after the payment of the tax for the annual period for which the alleged overpayment is claimed as required by the Act. "In this procedure, the burden will be upon the taxpayer tq show by strict proof that his transaction' is in substance like the Freeman case. If this is shown conclusively, the refund will be granted together with interest. This method, is recommended in all cases involving gross receipts from the sale of securities. "Furthermore, no deduction on current returns for the "tax paid i:pon gross receipts derived from the sale of securities made in previous years, will be allowed. The only method for securing a refund of the amount of tax paid on gross receipts from the sale of securities - in previous years is through the filing of a petition for refund for each, year within the statutory time provided by law. Each petition for refund will be decided upon its own factual situation ' in the strict conformity with the ultimate findings in the Freeman Case." Sullivan

Washington State Cows Lead in Bulterfat WASHINGTON (UP) Wash inton state cows on dairy herd improvement association test stand first in the nation in average butterfat production according to the Department of Agriculture. In 1945, Washington state cows produced an average of 376 pounds of butterfat. This compared with a national . average of 346 pounds.
