Judge Parr of the Lebanon Circuit Court spent a portion of Thanksgiving Day hearing the arguments on the motion to dissolve the restraining order in the case of Wm. D. Frame et al. vs. David H. Shockley et al . for public drain. Tf was his first case and was an important one. The Ben-Hur Traction Company had secured a temporary restraining order against M. J. Hannawait, the contractor, who is dredging the Eel R: . >r drain preventing him from Intel r'ring with the company's bridge ac; *s the drain. The contractor sought to bare this restraining order dissolved, while the traction company desired to have it made permanent. The request for a special finding was wit tdrawn anil Judge Pirr rendered judgment for the petitioner that tlie temporary restraln-

ing order tie made permanent. Tim Ben-Hnr Traction Company wi.st represented by Whittington A: Williams of this city, while Attorneys Terhune A: Higgins of Lebanon appeared for tlie defense. The contractor was restrained by an order of court issued bv Judge Artman in October. The defendant was proposing to blow up the cement bridge with dynamite. The destruction would have been quite a loss to the BenHur. as it is constructed with three twenty-five foot spans and was built at a cost of fG.OOO. Judge Parr's injunction will prevent the contractor from destroying any part of the bridge, as the report of the commission which made the investigation reported that the eontractor could get beneath the bridge without doing it anj injury. The bridge is located near Jamestown. — Craw fordsville Review.
The first winter month may spring surprises, judging from the state weather bureau record for December for the last thirty-seven years issued Saturday. The average temperature for the period named is shown to have been thirty-three degrees Fahrenheit, which may be termed mild winter weather. However, it has been shown that the thermometer c.m drop as low as fifteen degrees below j zero. That was the temperature I>eember it. isTfi. On two occasions w ithin Hie history of the bureau the temperature has run as high us six-ty-eight degrees Fahrenheit—December 31. 1S75, and December 24,
18S9.
There may be some snow. The records show that on December 14, ls:t!i. there was a fall of C.9 inches, the heaviest since a record of snowfall has*been kept. The month is unusually a cloudy month. The average in thirty-seven years has been sixteen cloudy days: nine partially cloudy, and only six clear days.

Faseett A. Cotton, state superintendent of public instruction, in his November bulletin to the teachers of i the state issued recently, discusses | ? he erganizallcn and operation of In-! diana's school system. In treating of 1 the strength and weakness of the sys- j tern Mr. Cotton says that the schools j of Indiana are stii suffering from the j blight of partisan politics. He says j that the constant progress of the , schools of a county depends upon the i "energy, intelligence and sanity of! tlie county superintendent.” Mr. Cotton says further that the schools of Indiana appear to suffer most from politics as encountered in the township, cities and towns. Mr. Cotton asserts that the hope of education in Indiana lies in a divorce from politics As the system's greatest strength Mr. Cotton points to its unity of purpose. He also commends it for encouraging ability in teachers, for leaving individualism unhampered and the right of initiative unquestioned In so far as it merely seeks to pb' e its teachers in the treadmill of mei mechanical ryutine, Mr. Cotton says, the system is to be con-
' demned.
There was wrath and profanity in the clerks olflee this morning when the true inwardness of tlie hunter's license became apparent to a wouldbe Nimrod. Tlie man had come to the office to take out a license. Be-, fore giving up his dollar he made inquiry as to what rights the paper) conferred. He was informed tha- it | gave no rights at all. That after hav-! ing the license the man could not! hunt without the written consent of! the man on whose hind he wished to I shoot. Then the explosion came. As a matter of fact there is a great deal of dirsatisl'action with tlie resident license. It is of no value except to create a fund to hire game wardens. It protects no game. It leaves the power where it belongs, in the hands of the man who owns the land that must be hunted over. The theory that the slate owns tlie wild game is becoming weaker and weaker. In practice the game belongs to the man on whose farm it grows, whose grain feeds it. He lias the right to say whether it tha 11 be hunted, the right to declare whether hunters shall shoot upon his land. The license is without value. It creates a fund to pax office holders, most of whom are not land owners and are pseudo-sportsmen, with their own desites to kill. It is believed that quail and squirrel should be protected. Neither should be killed. But only the farmers are interested. They aid him, are on his land. He should have the say in the matter. If he xvishes to hunt his own ground he ought not to be taxed to support a
warden.
