Charles of Indianapolis testified of having borrowed $5 of Emery in December, preceding the murder. Emery Cassell’s former employer H. C. Modrell of Indianapolis told, on the stand of having borrowed $225 of Cassell in January. He also testified as to the defendant character, saying that he had employed him as manager of his department store, 939 Massachusetts avenue. Indianapolis. Ho said Cassell had charge of

CASSELL JURY DISAGREE The jury in the case of the State vs. Emory Cassell, charged with the murder of the late Thomas Mills, was discharged at two o’clock Monday afternoon on account of being unable to agree upon a verdict. The case was given to the jury at 3:30 o’clock Saturday afternoon and the street rumor on Sunday was tha* they stood eleven for acquittal and one for the conviction. It was announced from Spencer that Steve Phillips, former sheriff of Owen county who refused to agree to a verdict of aequitt .1 ind stood for
