Mae Ernest, Colored Brings Suit Against the Red Cross Drug Store Asking Damages Because* of a Refusal to Sell Her Soda.

drug store, in which the plaintiff attempts to collect damages from the store because the proprietor refused to sell the plaintiff a glass of soda water came up for hearing in Squire Ashton’s court. The defendant through his attorney, B. F. Corwin, entered a demurer alleging that the ease did not come under the statute of civil rights and the offense wasnot actionable. Attorney Corwin stated that the higher courts of Indiana had never passed upon the question. He showed that in New York the courts had refused to consider a boot blacking shop as untier t ie =i - tute, in Ohio a saloon and lunch counter was not so classed by the higher court. In Illinois the supreme court had passed upon an almost similar case, in which a colored man had been refused a phosphate at a soda fountain in a drug store and had sued. All the courts from lowest to the highest had refused to consid- I er the case as falling under the statute, and found for the defendant. Squire Ashton, however, in spite of this showing, over-ruled the demurer, and the case went to trial. The plaintiff, represented by Theodore Crawley and George Wilson proved the plaintiff was in the Red Cross drug stor e on June 25 That she asked for Ice cream soda, and was told that they did not desire to sell their goods to colored people.
