After deliberating forty-eight hours, during which fifty-one ballots were taken, the jury in the Harvey Hinkle murder case at Bloomington returned a verdict shortly after 4 o’clock Sunday afternoon. It read: ‘‘We, the jury, find the defendant not guilty on the sole ground of in-
sanity.”
Although it was Sunday, and notwithstanding that the impression generally was held that the jury was hopelessly divided and unable to agree, the court room was packed to overflowing and many spectators were in the county clerks office and
corridors.

It was a busy day with the County Commissioners, and road matters ov er the county were largely responsible for it. The session began early, with the hearing of the remonstrance against the location of highway prayed for in the petition of John Poll and others in Floyd township. The engineer and viewers had reported favorably on locating the road. A remonstrance containing 85 names was received by the commissioners Mon morning, the remonstrators declaring that the road was not and would not be a public utility. Also a remonstrance' from Eddie Hinkle for damages. After hearing evidence the board decided that Hinkle was not the owner of the property purporting to be damaged. He had purchased the property and was in possession, but had paid no money and received no deed. The remonstrance was held void, hut was amended to include the name of Mr. Runyan, of whom Hinkle had purchased the property, and was again filed. The board appointed viewers to re-view the road with reference to i" pit Vie itiHI'y end to d.images to the remonstrators. The J. E. Brackney road, the S. H. Judy road, the Wesley Flint road and the Vermilion road, all in Clinton township, were let. The bidders were as follows: The J. E. Brackney road, D. C. Brackney, $8,34t».83. He was the only bidder. S. H. Judy road, the bidders were, Browning & Pursell, $1 1,373. D. C. Brackney, $11,895. C. B. Shaner et al $12,100. Glidewell & Son, $12,150. Tlie con*ract wont to Browning & Pursell. Glidewell & Son were the only bidders on ! the Wesley Flint road, getting it for $10,678. They also secure the Vermilion road at $9,000, there being no other bids. v

A suit for divorce was Tues filed by Attorneys Allee & Hughes acting for Hattie Rogers, against Hurschel Rogers. The complaint alleges cruel and inhuman treatment as the ground for the divorce. The complaint further alleges that the defendant is possessed of property which he has purchased with money belonging to the plaintiff. She asks that she be granted an absolute divorce, given the custody of the three children—two girls and a boy,—and that the husband be mandated t? j
exhibited the indifference noticeable since the day of his arrest and all through the trial. On the way back to jail Sheriff Ratcliff asked him what he thought of the verdict and Hinkle replied: "It was about what 1 had expected.” There was not even a smile on the defendant’s face as his attorneys shook hands with him. The trial began Iasi Monday morning at 8 o’clock and ended Mon afternoon. Hinkle was accnssed of shooting John R. McClintock, with whom he was not even acquainted, as McClintock was escorting Miss Edna Rogers home at 11 o’clock at night from the theatre. Hinkle was brought here and kep’ o\er night in jail, as he was being taken to Bloomington from Missouri where he was arrested. His brother, Sim Hinkle, is bartended for Walter Higert.

MARTINSVILLE, Ind., May 4.— Judge Williams, today, overruled the motion by attorneys for Emery Cassell, defendant in the Mills murder N case, to require the State of place the names of all witnesses now known on the Indictment charging him with murder In the first degree, and add to the list such names as the prosecuting attorney may discover from time to time, whom he intends to use as the case advances. The defense alleged that the State had other witnesses, and that it was necessary to know their names, and to show what their testimony would be, in order to meet this. The court assumed that fhc prosecuting attorney was acting in good faith in seeking permission of the court to place the names of new witnesses on the indirtment as the trial advanced and held that the motion would he regular and proper. The motion by the defense was filed , week ago before Judge Williams, in the Owen Circuit Cburt, and war taken under advisement till today.

Alvin Hanks was Monday elected by the township trustees to office of truant officer for the county. Two ballots were necessary for choice. The first showed these results: Alvin Hanks, 3; Ed Gardner, i; G. W. Beaman, 2; Rob Irwin, 2: J. V. Cook 1. That was more in the nature of a complimentary note, pih! on th<» second ballot Alvin Hanks was chosen, receiving 8 votes, Beaman 3 vote, and Irwin 1. Mr. Hanks will have charge of all truancy cases in the county.
