Special to The News-Times: NILES, Mich.. Oct. 7. -The case of the Staples and Ackerman Co. against the Southern Michigan Railway company is on trial in the Berrien county circuit court at St. Joseph. Th case arises from an accident which occurred In 1918 when an interurban car struck a digging outfit owned by the plaintiffs, the collision occurring at the Michigan st. crossing in this city. Among the witnesses on the stand yesterday were City Clerk Carl Cameron, who was subpoenaed t0 give testimony regarding the city ordinance which requires that the interurban cars shall not travel at a greater speed than 10 miles an hour within the city limits. The plaintiffs claim that the car was travelling at a higher rate of speed than the ordinance permits when the collision occurred.
