Alkfrinic: failure to perform the conditions of a contract entered into on Feb. 5. 1920. John I,. Worden and Sadlo D. Worden of the Worden Keulty Co., Fred C. Klein as at-torney-In-fact. Wesley Van Valen and Owen J. Windle arc made joint defendants in a Fuit for damn eres tiled in tho superior court by William and Lavina Knieper. Judgment in the sum of I -.000 is ask-d as reimbursement for the estimated loi.a through tho alleged failure of the deal to materialize. According to tho complaint the plaintiffs purchased lot No. IS in Martin's addition, valued at S-'hOO and deposited with Atty. Klein $.1.0u(. in compliance with the terms of the conlract, which further provided that an additional $0.000 was to ho paid within 6 0 days, the defendants agreeing to execute and deliver a warranty deed upon the second payment. It is further stated that the deed was to be made subject to a mortfrae of $10,000, which the rlainth'fs were to assume. The comjilalnant declares that on April 3, within tho stated 60 day period, the additional $5,000 was tendered to Atty. Klein but was refused and a demand for the delivery of the warranty dee, l was also spurned. A demand for the return of the original $3,000 was met with refusal according to the complaint, and a second paragraph to the complaint asks for tho return of the money with interest from Feb. 5.
