Mrs. Mayer stated her husband had deserted her last October and that aetic n was being brought to secure entire in'erest in a joint land contract. She is now working to provide a living for herself ai.d three children.

Charge Illegal Summoning of Witness in Superior Court Case.
Suit for Jö.euu damace.-: bled by Augu&Un and Florence Ciliuor" against Joseph I. Ryan and Ixretta Carey in superior court Saturday immediately after a decision had been given In the habeas corpus case brought ngainst Mr. and Mrs. Gilmore, will be contested because of illegal service according to local attorneys who are representing Mr. Pyan and Miss Carey. Rrief and summons had been prepared before the close of the case for the possession of the son of Miss Carey and as soon as Judge Montgomery ruled that the custody of the child should remain with the foster parents', the suit for damages was hied and summons served in the court room. "This is contrary to law." said the attorney for Miss Carey of the case. "In case it is necessary for people to mm" from another state to rrotect their interest in legal actions, they are allowed to leave that state and return to their place of residence betöre summons can be served on thorn. Roth Mr. Ryan and Miss Carry were not out of the court room when the summons in this case wjis served. Court in the preceding case had not been closed and we intend to contest the case on that ground." tiavc up Possosloii. Lorctta Carey, the mother of Xormand Verne Redmond, gave up possession of her child to the Gilmore family on the condition that they adopt him. When this was not done, she secured possession of the child and habeas corpus proceedings were tiled in the superior court of Cook county, Illinois, by Mr. Gilniore. The decision of Judge Cooper in that court awarded the custody of the child to Gilmore and an appeal was immediately taken to the appellate court by Miss Carey. Soon thereafter Mrs. Oilmore joined her husband in South Rend where he has been working as a public accountant. Miss Carey followed" and filed habeas corfus proceedings in the superior court, allesins that the l.oy should bo with her because of the appeal to the higher court. After a hearing before Judge Montgomery, the ruling of the court was that the decision of Judgo Cooper awarding the custody of the child to the foster parents until the appellate court ruled was upheld.
