O'Leary, the Sinn rein leader charged with conspiracy to cominit treason and espionage, who va lrousht here Monday under htay guard after having been arre.sttd last week in Sara, Wsuh., as a fugitive from justice, was pleading not truilty to the federal indictments atainst him. witnesses in the trial of his brother. John J. O'Leary. accused of assisting him to escape, were testifying a to Jereriiah's physical und mental condition. The apparent object of this testimony was to lay the groundwork of Jeremiah'.s defense when he is tried on the conspiracy charges. Iri-oncr's Mental Condition Poor. Arthur I. Lyons, who turned government witness after beint? indicted with John O'Leary for conspiring to remoe the "inn Feiner frotn the court's jurisdiction on the eve of his trial for publishing alleged seditious articles in Dull, and who accompanied Jeremiah west, described his traveling companion as being "very restless and nervous with no fixed mental condition." When James U. Speer, a New York lawyer, who occupied offices with Jeremiah O'Leary, was aked en the stand his opinion of Jeremiah's mental state, he replied that lie "looked upon him as a replica of Harry Thaw." This testimony followed the arrival and arraignment hero of Jeremiah who after entering pleas of not guilty to the latest charges against him was held without bail and olaced in the Tombs prison, r.efore he was placed In his cell Jeremiah told newspaper men that he had had six weeks' rest, adding that he needed it, for he was "in pretty bad shape."

On May 2 7 Lyons said he showed O'Leary an article in a New York paper regarding LLeary's indictment with four more Americans and two (lermans on charges of conspiracy to commit treason and espionage and the fugitive said that he "expected it" and spoke of being a martyr for Irish freedom." He said he finally obtained $200 frcm O'Leary with which to come home after O'Leary had sug-gested that he would return via Mexico, to leave the impression that O'Leary was there.
