The will of raul Herring; of this city, who committed suicide by hanuing here Nov. 19, was tiled for probate In the circuit court. I'nder the will, executed Icc. 4, 190b, btiuevts are made na follows: To Mary A. Schaefer of Goshen, $000. To Hannah 1,. Urickett of near Hrocton. AIa... J-ister, $1,300. To FJleunor A. Herring of Chicago (daughter of Frederick llerring1, deceased), niece, J 1 0J. The residue is to be divided equally between Dr. John 11. Herring of Kau Claire, Mich., and Dr. Nathaniel A. Herring, of lienton Harbor, Mich., brothers. On the reverse side of the pases of his will Mr. Herring kept something of a list of notes and other Investments. The record is not entirely clear to those who were but slightly informed on his personal affairs and so far as is known here nobody had his confidence on money matters. Until a safety deposit box at the Klkhart County Trust Co. was inspected yesterday it was not certain that Mr. Herring, had left !a will. In this box a number of notes and mortgages were found and it is said they throw lUht on several or his investments that are in uome quarters rated uh worthless. In all probability a relative of Mr. Herrin? will qualify as executor of the will instead of Daniel M. Urehtel of Goshen and Indianapolis, who was nominated. makki.;i; lu i:six Robert L. BRITISH OFFER TO
.5. Laws of U. S., however, Compel Daniels to Decline Recognition of Bravery. WASHINGTON, Nov. ;iAn offer l-y the Kriti.sh admiralty to decorate certain officers, and men .f two American destroyers for their services in ombatting; German submarines has been declined, w'y Daniels announced lYiday bocause the laws of this country prevent sohliers and sailors from receiving decorations from foreign governments. Lieut. Commanders Charles A. Blakley and George F. Neil were to be nominated for the distinguished service order; Lieut. Frank Loftin, and Ensign Henry N. Fallon for the distinguished service cross, and Quartermaster W. II. Justice and Chief Machinist Mate It. G. McNaughton for the distinguished service medal. The names of the ships to which the officers and men are attacked were withheld for military reasons. The British admiralty's desire to decorate the men was transmitted through the British ambassador to the state department and referred by it to the navy department. Attacks Submarine. "In the case of- one destroyer," said a statement issued by Sec'y Daniels, "the admiralty advises that the vessel was convoying a merchantman when the periscope of a submarine was sighted at a distance of about 800 yards. "The destroyer Immediately increased speed and headed toward the submarine which submerged, but reappeared shortly afterward, traveling In the opposite direction. The U-boat next passed close on the starboard side of the destroyer which released a depth charge probably causing serious damage if mt destruction to the submarine. "Fraising the excellent organization, preparedness and discipline on beard the destroyer as well as the quick .decision of the officers of the watch, the British commander-in-chief proposed to recommend Lieut. Commander Blakley, the commanding officer, for appointment to :hc distinguished order and Ensign Henry N. Fallon for award of the distinguished service cross. Outmanouvrrs U-lkat. "Xhe other destroyer was one of a number escorting troop ships and was cruising In station formation when the wave of a periscope was sighted 1,800 yards off Jhe port bowby the quartermaster of the watch on duty. He reported to the officers of the watch who immediately Bounded general quarters. The executive officer of the destroyer was the llrst officer to reach the bridge, being closely followed by the commanding officer. The executive officer rang for full t-peed ahead on reaching the bridge and altered the destroyer's course to head for the periscope. "The commanding officer then took command of the ship and maneuvered her so as to rain a favorable position for dropping a depth charge, directing the executive officer to drop the charge -when he deemed it proper to do so. The charge was dropped, it is estimated, when the destroyer was about 2 3 yards directly ahead of the peris-cope and in the direction of the submarine's advance. lAidently Sunk. "After the explosion of the charge debri. was seen to rise to the surface accompanied by large hubbies and discoloration of the water. "For their services in this engagement the British commander-in-chief made the following recommendations: "Lieut. Commander Neal. for the distinguished service order because it was considered that the efficient way the attack was launched was due to his prompt and decisive action and the vieilant lookout maintained on the destroyer. "Lieut. Loftin for the distinguished service cross for the way he handled the situation in a prompt and decisive manner after arriving on the bridge. "Quartermaster, first class. Justice and Chief Machinist Mate McNaughton. for the distinguished service medal." NEARLY KILL TEACHER FOR SCOLDING CHILDREN BALTIMOIU'. Md., Nov. 24. Suits to test the constitutionality of the Indiana prohibition law which is to go into effect April 2, 191 S, were hied Friday in superior court by the F. W. Cook Brewing company, the Evansviile Brewing compnay and Henry Gergenrath. In each of the three suits a perpetual injunction against Lane B. Osborn. prosecuting attorney. Sheriff William Habbe and Chief of Police Edgar Schmitt is asked to prevent enforcement of the law. Each of the brewing companies declares in its complaints that Reinvestment is more than $1,000,000 and that enforcement of thu law could prevent the use of their property. The points on which th; law is chaVenged are that it allows druggists, chemists and hospital.-? to u.-e and dispense alcohol; that it arbitrarily defines what a nuisance shall be, that it denies the rights of propertj' and that the title of the act 's insufficient Ln that the act ron- . . . .... , . . . i tains suojects ana matter not specified in the title.
