Freyermuth. who has charge of the making up of the lunche for the soldiers announced Saturday that all boxes had been filled und this committee would not accept any more donations of "eats" for the hoys. Parents of the boys are asked not to arrange any lunches as the ones put up hy the committee will he sufficient. The lunch will be made up of: Three ham sandwiche. apples. oranaes, olives, pickles and boiled eggs. Holiday on Sunday. Col. Freyermuth stated Saturday that ;ill members of the various companies would he gien a holiday Sunday so that they can spend their last dav before leaving with tbir parents. A technical flaw in the affidavit will in all probability cause the state to lov.. its case apainst Alvin I. Itogtrs. president of the South Ilend Sanitary Milk Co.. according to Judye I.. M. Hammei schmidt. of itv court, in which the case was tried Saturday morning. Fvidenc. was submitted to chow that the law was violated, and no attempt to disprove this testimony was made. lUfore the testimony was bfgiin. the defendant's attorney made a formal motion to quash the affidavit, and when the etate rested after giving its evidence, the point of law was brought forth. The affidavit reads that milk was .-old to V. C. Cripe by Alvin .1. Hogers, "through his agent. John Hoe, whose true name is unknown." The evidence submitted by the state shows that the driver of the wagon i.Ionn I oe was not the servant or acent of Rogers, but of the Sanitary Milk Co. of which Rogers is president.
