County Auditor Hemenderfer has filed with the clerk of the ciurcuit court a transcript of the proceedings of th county commissioners at the June ttrm, K: 7, and th aflidavit of appeal of W. V. Hayncf and other taxpayers of the county, from the trder of the commissioners allowing a claim of Joseph H. Workman, ta:; ferret, for $7;5.7u as commission for discovering sequestered jiroperty lor taxation. The atfidait alleres the claim was allowed wi'hout authority and was illcfial and not owin;r by the county. The appeal notice was Id-d July :;. Atty. L. D. Hall, who prepared the complaint, a 1 lese the following reckons why the claim should aot have teen I lowed: Kirst That the property was not discovered by Workman under the contr.u t . or at all. Seeor.J That all property specified in the claim under the nrst installment of 1 f 1 ; taxes was on the l'Jl.. duplicate prior to Jan. 1, 1917, and was. continued from the 1 0 1 " duplicate to the l'lf duplbate hy the auditor; aus placed on the duplicate Py the ai'ditor and assessor. thereon became due and pa.va.ble. Fourth That Workman discoered the pr.porty mentioned in tht Items of the claim prior to the time id making the contract, and was paid for Iiis .services in the disco'. -cry and placing of the tame on the duplicate and cut of the county treasury prior to 1917. Fifth That the property for the discovery for which the claim is made and filed is in the Elkhart county and disclosed iti the public records in he county othces. Therefore, and for the leasons given, the plaintiff appeals to the circuit court from the order of the commissioners and the allowance the cl.-i'm permits. The main point in the contention is that Workman had already been paid once for discovering the properly and placing it on the dupUca there is no reason why he cannot continue to collect from year to year as loni: as the property is carried forward. Workman has a three year contract with the county, dated March H, 191, and on all taxes collected

th.e duplicate, and for which is collected the taxes. This is a statement gi en by Mr. Hall. It is alo stated hy Mr. Hall, when asked who would he responsible for the payment of the alleged illegal claim to the county, in case that the court holds that it was wrongfully allowed and paid, replied that the taxpayers would have redress on the 'oiinty commissioners.
