The case was tried in city court Wednesday morning before Special .lude ple. The state attempted to prove by its witnesses that Mrs. Shafer kept heer in an ice box in her restaurant which she sold to patrons. It also attempted to prove that the woman

(in tht stand th men asserted they did not know where she got tho heer, in fact, that they paid for the beer before it was delivered while the third declared he did not give the woman the money until the order was exec uted. Mrs. Shafer asserted that she went into the saloon next door sind secured the beer, so tint; as as-'ent for the three men. The beer was secured from si saloon sidjoiniir-r. She pointed out she did this on the advice of her attorney. George Kurt, who had told her this was si le-al proceeding, one of the smiusing incidents of the case came up when it was revealed that the interpreter who had been picked up in the court room was a witness for the defense. He had interpreted the testimony of the state's witnesses and then went on the stand, asserting he- was a boarder at the restaurant and knew that the defendant acted as an agent for the three men. He said that he kept beer in the woman's ice chest for his own use as did two other boarders ".t the restaurant. . The Mate had attempted to prove that the beer found in the ieo chest was being sold by the womstn. Judge Pyle found the woman not guilty but warned her to observe the law to the letter. The Indiana pubiic service commission will tight the Chicago. Lake Shore and South Bend I Lu.il way Co.'s suit to have the order requiring the company, stlong with the New York Central and the Chicago. South Bend sind Northern Indians' lisulway Co., to elevate its tracks over the Lincoln highway near New Carlisle, revoked or modified. A denial of all of the sillegations uiade by the South Shore lines in its suit against the commission has been tiled in circuit court. In its suit against the public service commission the South Shore lines gave seven reasons why the order should be revoked and gave otheni to hhow why it should he modified. The Chicago, S'outh Bend and Northern Indiana Kailway Co. issued si statement last week that it would not oppose the commission's order. Bvan P.. Stotsenburg. attorney generstl of Indiana; Burt New. attorney for the public service commission; Graham and Crane, local attorneys for the Lincoln Highway association, and P. J. Houlihan, attorney for the St. Joseph county commissioners, will handle the case for the public service commission when it comes up in circuit court.
